Nothing in these Terms is intended to prevent uses permitted by applicable copyright law that cannot lawfully be restricted by contract.
8. ACCESS AND AVAILABILITY
We aim to keep purchased Digital Content reasonably accessible through the Website. However, uninterrupted or error-free availability cannot be guaranteed.
Access may occasionally be affected by maintenance, software updates, security work, hosting interruptions, third-party service failures, internet or network failures, technical faults or circumstances outside our reasonable control.
Where a problem within our reasonable control materially prevents access, reasonable steps will be taken to restore the service. Nothing in this section removes statutory rights where Digital Content does not conform to the contract.
9. UPDATES AND CHANGES
Reasonable changes may be made to the Website and Digital Content where necessary to correct errors, improve functionality, maintain security or technical compatibility, update outdated information, improve presentation or accessibility, or comply with legal requirements.
This provision will not be used to remove fundamental paid-for content in a manner that unlawfully deprives a consumer of what they purchased.
10. JOURNALS, WORKSHEETS AND PERSONAL ENTRIES
The Website may provide journals, worksheets, assessments, prompts, reflection systems and other interactive tools for personal educational and self-reflection purposes.
Where information entered into these features is stored by the Website, its collection, storage and processing are governed by the Privacy Policy.
Do not use these features to store passwords, payment-card information, banking or brokerage credentials, cryptocurrency private keys, security codes or other authentication credentials.
11. ASK THE AUTHOR
Purchasers may have access to an Ask the Author feature. Questions may be reviewed or moderated before being answered or displayed.
Submitting a question does not guarantee that it will be answered, answered within a particular period, published, or that individual coaching or personalised professional advice will be provided.
Questions or submissions may be refused, moderated or removed where reasonably considered unlawful, abusive, threatening, discriminatory, infringing, promotional, spam, deliberately disruptive or otherwise inappropriate.
Responses are general educational commentary and should not be treated as personalised financial, investment, legal, tax or other professional advice.
12. EDUCATIONAL PURPOSE
Mirror of the Trader is primarily a trading-psychology, behavioural and personal-experience publication. Its purpose is educational and reflective.
Content may discuss trading psychology, emotional behaviour, decision-making, discipline, cognitive biases, risk perception, the author’s personal experiences, trading mistakes, behavioural patterns, personal development and general market-related experiences.
The Digital Content is not intended to provide personalised financial advice.
13. NO FINANCIAL OR INVESTMENT ADVICE
Nothing on the Website or within the Digital Content constitutes personalised financial, investment, legal or tax advice or a personal recommendation to buy, sell, hold or trade a particular investment, security, derivative, financial instrument or other financial product.
The author does not manage customer funds or make trading decisions on behalf of customers through Mirror of the Trader.
Purchasing the book, accessing the Website or communicating through Website features does not create an adviser-client, fiduciary, brokerage, investment-management or similar professional relationship.
Where you require regulated financial advice, consider obtaining advice from an appropriately authorised professional.
14. TRADING AND INVESTMENT RISK
Trading and investing involve financial risk. You may lose money, including potentially all capital committed to a particular trading or investment activity.
Examples, personal experiences, psychological observations and past trading outcomes discussed within Mirror of the Trader are not guarantees or predictions of future performance.
Mirror of the Trader does not guarantee that purchasing or using the Digital Content will make you profitable, prevent trading losses, improve investment returns, enable you to pass a proprietary trading evaluation, obtain a funded trading account, generate a particular income, achieve financial independence or produce any specific financial result.
Your trading and financial decisions remain your responsibility.
15. NO GUARANTEE OF RESULTS
Mirror of the Trader is a psychology and educational product. Individual experiences and outcomes vary.
Testimonials, examples, hypothetical situations, personal stories or descriptions of the author’s experience must not be interpreted as promises or guarantees that another person will achieve the same or similar result.
16. UK CONSUMER RIGHTS
Where you purchase as a UK consumer, applicable consumer-protection law applies. Digital content supplied to consumers is subject to applicable statutory requirements, including requirements concerning conformity of digital content.
Nothing in these Terms excludes, limits or replaces statutory rights or remedies that cannot legally be excluded. Where Digital Content is faulty, not as described or otherwise fails to meet applicable statutory requirements, you may have remedies provided by law.
17. DIGITAL CONTENT, CANCELLATION AND REFUNDS
Mirror of the Trader is digital content supplied online rather than on a tangible medium.
Where immediate access is provided during a statutory cancellation period, the checkout process may ask you to expressly consent to supply beginning immediately and acknowledge the effect this has on any statutory cancellation right, to the extent provided by applicable law.
The detailed rules are explained in the Purchase, Access, Cancellation & Refund Policy.
Nothing in these Terms removes any statutory remedy you are legally entitled to where Digital Content is faulty, not as described or otherwise fails to conform to applicable law.
18. ACCOUNT SUSPENSION AND TERMINATION
Access may be temporarily suspended where there are reasonable grounds to investigate suspected account sharing, unauthorised access, payment fraud, attacks or abuse, unauthorised redistribution, serious breaches of these Terms or legal obligations.
Paid access may be permanently restricted or terminated for serious or repeated breaches such as deliberate piracy, resale, systematic unauthorised redistribution, fraud, deliberate circumvention of Website security or serious unlawful use.
Actions will be proportionate to the circumstances. Nothing in this section affects statutory consumer rights or remedies.
19. THIRD-PARTY SERVICE PROVIDERS
Mirror of the Trader currently uses Stripe for payment processing, Supabase for customer authentication and database infrastructure, Netlify for Website hosting and server infrastructure, and Resend for transactional and newsletter email infrastructure.
Further information about personal information is provided in the Privacy Policy.
20. EMAIL COMMUNICATIONS
Transactional emails necessary for your purchase, account or security may include account activation, email confirmation, password reset, security notifications, purchase-related communications and other essential service messages.
Transactional communications are separate from marketing communications.
Purchasing Mirror of the Trader or creating an account does not automatically subscribe you to marketing emails. Where you choose to receive marketing communications, you may unsubscribe using the method provided.
21. EXTERNAL LINKS AND REFERENCES
The Website or Digital Content may refer or link to third-party websites, books, research, platforms, services or resources. Unless expressly stated otherwise, such references do not mean Mirror of the Trader owns, controls or endorses the third party. Third parties operate under their own terms and privacy practices.
22. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation or any other liability that cannot lawfully be excluded.
Nothing excludes or restricts statutory consumer rights.
Subject to those protections, Mirror of the Trader does not accept responsibility for financial losses arising merely because a customer chose to make a trading or investment decision after reading educational, psychological or autobiographical material contained in the Digital Content.
No financial, trading or investment outcome is promised or guaranteed.
23. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delay or failure caused by circumstances outside our reasonable control where permitted by law. Where such an event affects access to paid Digital Content, reasonable steps will be taken to minimise disruption and restore access.
24. CHANGES TO THESE TERMS
These Terms may be updated where reasonably necessary because of changes to the Website, Digital Content, technology, security requirements, third-party services or applicable law.
The current version will be displayed on the Website with its effective or last-updated date. Updated Terms will not be used retrospectively to remove statutory or contractual rights already acquired by an existing customer.
25. GOVERNING LAW
These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply to consumers elsewhere.
26. SEVERABILITY
If any provision is determined to be unlawful, invalid or unenforceable, it will be modified or removed to the minimum extent necessary and the remaining provisions will continue to apply.
27. RELATED POLICIES
These Terms should be read together with the Privacy Policy, Cookie Policy, Purchase, Access, Cancellation & Refund Policy, Digital Content Licence and Trading & Educational Disclaimer.
